1. Introduction and Acceptance of Terms

Welcome to m4umakhija.in, owned and operated by Makhija Trendz under the brand name M4U Makhija, a manufacturer and seller of fabrics, kurtis, and related apparel and textile products. These Terms and Conditions (“Terms”) govern your access to and use of the Website, including browsing, account registration, and the purchase of products.

By accessing, browsing, registering on, or placing an order through the Website, you (“User,” “you,” “your”) agree to be bound by these Terms, our Privacy Policy, and any additional terms referenced herein. If you do not agree to these Terms, please discontinue use of the Website immediately.

These Terms constitute a legally binding agreement between you and M4U Makhija under the Indian Contract Act, 1872, and are also framed with reference to the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000.

2. Definitions

  • “Products” means fabrics, kurtis, and other apparel/textile items offered for sale on the Website.
  • “Order” means a request placed by a User to purchase Products through the Website.
  • “Account” means a registered User profile on the Website.
  • “Content” means all text, graphics, images, logos, product descriptions, and other material appearing on the Website.

3. Eligibility

To use the Website and place an Order, you must:

  • Be at least 18 years of age, or use the Website under the supervision of a parent or legal guardian;
  • Be capable of entering into a legally binding contract under the Indian Contract Act, 1872;
  • Provide accurate, current, and complete information during registration and checkout.

We reserve the right to refuse access to or cancel Orders from any User who does not meet these eligibility criteria or who has previously violated these Terms.

4. Account Registration

  • You may be required to create an Account to place an Order or access certain features of the Website.
  • You are responsible for maintaining the confidentiality of your Account login credentials and for all activities that occur under your Account.
  • You must notify us immediately at enquirym4umakhija@gmail.com of any unauthorized use of your Account.
  • We reserve the right to suspend or terminate Accounts that provide false information, violate these Terms, or engage in fraudulent activity.

5. Products, Descriptions, and Pricing

  • We make every reasonable effort to display Product descriptions, fabric composition, colors, sizes, and images as accurately as possible. However, due to factors such as screen/display settings, handloom/handcrafted variations, and dye-lot differences inherent to fabric and kurti manufacturing, slight variations in color, texture, print placement, or embellishment between the Product shown online and the Product delivered may occur and shall not be considered a defect.
  • All prices listed on the Website are in Indian Rupees (INR) and are inclusive/exclusive of applicable GST as indicated at checkout. Prices are subject to change without prior notice, except for Orders already confirmed.
  • We reserve the right to limit quantities, discontinue Products, or refuse/cancel any Order at our sole discretion, including in cases of pricing errors, suspected fraud, or stock unavailability. In such cases, any amount already paid will be refunded to the original mode of payment.

6. Order Placement and Acceptance

  • An Order is placed when you complete the checkout process and make payment (or select Cash on Delivery, if available).
  • Receipt of an order confirmation email/SMS does not constitute our acceptance of your Order; it is an acknowledgment that we have received it. A contract of sale is formed only when we confirm dispatch of the Product(s).
  • We reserve the right to cancel or refuse any Order due to stock unavailability, pricing/description errors, suspected fraudulent activity, or inability to verify delivery details, with a full refund of any amount paid for the cancelled items.

7. Payment Terms

  • We accept payments through the modes listed at checkout, which may include credit/debit cards, UPI, net banking, wallets, and Cash on Delivery (COD), where available.
  • All online payments are processed through RBI-authorized third-party payment gateways. We do not store your complete card or banking credentials on our servers.
  • In the event of a failed transaction where an amount has been debited from your account, the amount is typically auto-reversed by your bank/payment provider within their standard reversal timeline. If you do not receive the reversal, please contact us with the transaction reference and we will assist in resolving it with the payment provider.
  • COD orders, where applicable, may be subject to a maximum order value limit and/or COD handling charges, as indicated at checkout.

8. Shipping and Delivery

  • We currently ship Products to addresses within India.
  • Estimated delivery timelines are provided at checkout/order confirmation and are indicative, not guaranteed. Delays may occur due to courier partner constraints, weather, strikes, regional restrictions, or other circumstances beyond our reasonable control.
  • Risk of loss and title to Products pass to you upon delivery to the shipping address provided.
  • It is your responsibility to provide accurate and complete shipping information. We are not liable for non-delivery or delay caused by incorrect or incomplete address details provided by you.
  • Shipping charges, if any, will be clearly displayed at checkout.

9. Cancellation Policy

  • You may cancel an Order before it has been dispatched by contacting us at enquirym4umakhija@gmail.com or +91 99981 45257.
  • Once an Order has been dispatched, it cannot be cancelled; you may reach out to us regarding a return in accordance with Section 10, if the Product is eligible.
  • We reserve the right to cancel Orders in cases of stock unavailability, pricing errors, or suspected fraudulent activity, with a full refund of amounts paid.

10. Returns, Refunds, and Exchanges

Our team will guide you through the applicable process, eligibility, and timelines for your specific order.

11. Intellectual Property Rights

  • All Content on the Website, including but not limited to the M4U Makhija name, logo, product designs, photographs, graphics, and text, is the exclusive property of Makhija Trendz or its licensors and is protected under applicable Indian and international intellectual property laws, including the Copyright Act, 1957, and the Trade Marks Act, 1999.
  • You may not copy, reproduce, republish, distribute, modify, or create derivative works from any Content without our prior written consent.
  • Any unauthorized use of our Content, trademarks, or Product designs may result in legal action.

12. User Obligations and Prohibited Activities

You agree not to:

  • Use the Website for any unlawful purpose or in violation of these Terms;
  • Provide false, inaccurate, or misleading information;
  • Attempt to gain unauthorized access to the Website, servers, or any connected systems;
  • Upload or transmit viruses, malware, or any harmful code;
  • Engage in any activity that disrupts or interferes with the functioning of the Website;
  • Scrape, copy, or use automated means to extract data or Content from the Website for commercial purposes without authorization;
  • Post or transmit any defamatory, obscene, or unlawful content through any reviews, comments, or communication features on the Website.

We reserve the right to suspend or terminate access to the Website for any User found violating these obligations.

14. Disclaimer of Warranties

  • The Website and all Products are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, except as required under applicable consumer protection law.
  • We do not warrant that the Website will be uninterrupted, error-free, or free from viruses or other harmful components.
  • Minor variations in fabric texture, color, print, or embellishment, arising from the nature of textile manufacturing and dye lots, are not considered defects and do not constitute a breach of warranty.

15. Limitation of Liability

To the maximum extent permitted under applicable law, M4U Makhija and Makhija Trendz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Website or Products, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising from your use of the Website or purchase of Products shall not exceed the amount paid by you for the specific Order giving rise to the claim.

Nothing in these Terms shall exclude or limit liability that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019.

16. Indemnification

You agree to indemnify and hold harmless Makhija Trendz, M4U Makhija, its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, misuse of the Website, or violation of any applicable law or third-party rights.

17. Force Majeure

We shall not be held liable for any failure or delay in performance of our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, government restrictions, courier/logistics disruptions, or other events of force majeure.

18. Privacy

Your use of the Website is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Website, you consent to the practices described in our Privacy Policy.

20. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to Section 21 below, the courts at Ahmedabad, Gujarat shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

21. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or your use of the Website, both parties shall first attempt to resolve the matter amicably through our customer care/grievance channel. If the dispute is not resolved amicably within a reasonable period, either party may refer the matter to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat and venue of arbitration at Ahmedabad, Gujarat, conducted in English, before a sole arbitrator appointed by mutual consent. This is without prejudice to your rights under the Consumer Protection Act, 2019, to approach the appropriate consumer forum/commission.

22. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or authority of competent jurisdiction, the remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy and any Order-specific terms disclosed at checkout, constitute the entire agreement between you and M4U Makhija regarding your use of the Website, superseding any prior agreements or understandings.

24. Amendments

We reserve the right to modify, amend, or update these Terms at any time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Website following any such changes constitutes your acceptance of the revised Terms.
